BACKGROUND: This agreement applies between you, the User of this Website and Weyron Ltd, the owner(s) of this Website. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately.
1. Definitions and Interpretation
In this Agreement the following terms shall have the following meanings:
 
“Content” - means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Website;
 
“Weyron” - means Weyron Ltd a company incorporated in England and Wales under number 08617932 whose registered office is at Unit 6 Fingle Drive, The IO Centre, Stonebridge, Milton Keynes, MK13 0AT
 
“Service” - means collectively any online facilities, tools, services or information that Weyron Ltd makes available through the Website either now or in the future;
 
“System” - means any online communications infrastructure that Weyron Ltd makes available through the Website either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities and email links;
 
“User” / “Users” - means any third party that accesses the Website and is not employed by Weyron Ltd and acting in the course of their employment; and
 
“Website” - means the website that you are currently using (Weyron.co.uk) and any sub-domains of this site.
2.Intellectual Property
 
2.1 All Content included on the Website, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Weyron Ltd, our affiliates or other relevant third parties. By continuing to use the Website you acknowledge that such material is protected by applicable to the United Kingdom and International intellectual property and other relevant laws.
 
2.2 Subject to sub-clause 2.3 you may not reproduce, copy, distribute, store or in any other fashion re-use material from the Website unless otherwise indicated on the Website or unless given express written permission to do so by us.
 
2.3 Material from the Website may be re-used without written permission where any of the exceptions detailed in Chapter III of the Copyright Designs and Patents Act 1988 apply.

6.1 Weyron Ltd makes no warranty or representation that the Website will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from the use of our Service.
 
6.2 No part of this Website is intended to constitute advice and the Content of this Website should not be relied upon when making any decisions or taking any action of any kind.
 
6.3 Whilst Weyron Ltd uses reasonable endeavours to ensure that the Website is secure and free of errors, viruses and other malware, all Users are advised to take responsibility for their own security, that of their personal details and their computers.
7.Availability of the Website and Modifications
 
7.1 The Service is provided “as is” and on an “as available” basis. We give no warranty that the Service will be free of defects and/or faults. To the maximum extent permitted by the law, we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of the information, compatibility and satisfactory quality.
 
7.2 Weyron Ltd accepts no liability for any disruption or non-availability of the Website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.
 
7.3 Weyron Ltd reserves the right to alter, suspend or discontinue any part (or the whole of) the Website including, but not limited to, the products and/or services available. These Terms and Conditions shall continue to apply to any modified version of the Website unless it is expressly stated otherwise.
 
8.Limitation of Liability
 
8.1 To the maximum extent permitted by law, Weyron Ltd accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Website or any information contained therein. Users should be aware that they use the Website and its Content at their own risk.
 
8.2 Nothing in these terms and conditions excludes or restricts our liability for death or personal injury resulting from any negligence or fraud on the part of Weyron Ltd.
 
8.3 Every effort has been made to ensure that these terms and conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977. However, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This term shall apply only within jurisdictions where a particular term is illegal.
 
9.No Waiver
 
In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.
 
10.Previous Terms and Conditions
 
In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.
 
11.Third Party Rights
 
Nothing in these Terms and Conditions shall confer any rights upon any third party. The agreement created by these Terms and Conditions is between you and Weyron Ltd..
 
12.Communications
 
12.1 All notices/communications shall be sent to us either by post to our Premises (see address above) or by email to Weyron Ltd. Such notice will be deemed received 3 days after posting if sent by first class post, the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday.
 
12.2 Weyron Ltd may from time to time send you information about our products and/or services. If you do not wish to receive such information, please click on the “Unsubscribe” button on the email you receive from us.
13. Delivery of goods
We are making every effort to dispatch the same day the funds cleared and our regular transit time is between 2-5 days in the UK and 3-10 days in the rest of Europe (excluded out of bounds areas)  however there are unforeseen events that may delay your order. Weyron Ltd shall not be held responsible for any delays that are beyond our control. We deliver to most EU countries but we advise you contact us before purchasing to check if the delivery is available in your country. The equipment ordered by you is subject to availability. In case your product is not in stock we will give an alternative option or a full refund. We reserve the right not to deliver to PO-BOXES, or where is no access for 40ft track or in areas that the delivery is very expensive due to limited access or distance. Additional shipping charges may be required to cover the delivery costs.  The supplied products remain the property of Weyron Ltd until fully paid for by the customer.

The items should be checked promptly upon delivery for damages and the delivery must be signed as damaged if not in perfect condition. If signed for the goods without the damaged mark means you agree that you have received it in good condition and Weyron LTD is not responsible for those damages.

At least 2 Strong persons is needed to move the boxes. If there is no access to your door we will only deliver to the closest location that we can and you are responsible to take it from there. If you refuse to take it from there a refuse collection fee will be charged on top of the initial shipping cost and return shipping cost.

White-Glove Delivery / In-Home Unpacking and Set Up - between 2-10 days – (additional cost)
Our delivery team can deliver and install the equipment in the room of your choice. The delivery team is not trained in using the massage chair and will not be able to train you on how to use your chair, so please consult your user manual for instructions on the operation of your new massage chair.
The packing material may be removed from your location if requested, but we strongly advise that you keep all packing material for 30 days in the event you wish to return your chair. If you do not retain your original packaging materials and require them in order to return your chair, you will need to purchase adequate packaging and repack the equipment yourself.
White-Glove Limitations:
The entire delivery pathway must have a minimum clearance of 28 inches. In case the team cannot take it upstairs due to space limitation, the customer must be prepared to place the chair in another accessible place in the house. If won't be placed in the desired location cannot constitute a reason for return unless Weyron Ltd agrees in writing that will definitely place the item on that location.

Customer shall not be held Weyron Ltd responsible for any damages made to customer property during the delivery or installation.

The White Glove delivery is only available upon request and at the cost to be agreed by Weyron LTD and the customer. If this service is not requested the delivery will be made by courier.

The White Glove Delivery is only available in England and Wales

13.Law and Jurisdiction
 
These terms and conditions and the relationship between you and Weyron Ltd shall be governed by and construed in accordance with the Law of England and Wales and we and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales

14. Quality and Use of Equipment
14.1 Weyron Ltd makes every effort to ensure that the massage chairs provided are of the highest quality. However, the manufacturer's ability to provide the quality of the product we require may be beyond our control. We make every effort to ensure that our products are fit for the advertised purpose. Please read any supplied instructions carefully before use. Weyron Ltd reserve the right to change product specifications, features, colours and materials without notice.
 
14.2 The products we sell are suitable for use by most adults. 
We recommend consulting a doctor or specialist before use if; 
you are pregnant
you have undergone major surgical procedures
you suffer from any pre-existing medical condition

you think that the massage in your chair may harm you in any way.
14.3Returns
Once you receive your Weyron brand massage chair, you have 7 days to return your chair to Weyron Ltd for a full refund (minus a bank processing fee ranging from 1.5% to 3.4% of the total amount, and depending on the card used ie credit, debit, AMEX, MasterCard etc) any delivery, shipping and handling costs). The chair must be in transit on or before the 15th day after delivery.  The money-back-guarantee is 7 days from delivery and, if returned after the 7th day, we will charge between £50-£250/ day for the entire period was in your possession for using the chair or a lump sum at Weyron's discretion but not exceeding the £250/day for each day was in your possession. Weyron won't accept any returns after 28 days from the delivery date.


Please note that the return policy also applies to chairs purchased from a third-party retailer as the massage chair must be returned to Weyron Ltd for a full inspection. For hygiene reasons, we are unable to accept returns for the head massagers.
All massage chairs must be returned to us in new condition and with any included materials such as manuals and instructions. 
If the original packaging for your massage chair is unavailable the customer must ensure that suitable packaging is used to protect the item. It is the customer's responsibility to return the chair and in a reasonable resalable condition otherwise charges for depreciation may be deducted at Weyron's discretion. We recommend taking transit insurance to cover the item while in transit.
Before returning a massage chair, please contact our team for a Return Authorisation Number (RA). If this is not provided, our receiving department will be unable to accept your chair.
Any additional services such as delivery options or installation will be non-refundable if an item is returned.

We can exchange the product within 7 days from the date you have received it, but additional shipping costs will apply.
If the massage chair cannot be delivered due to a failure to measure the doors, or the customer return it because doesn't fit through the door, a two way wasted delivery journey will be charged at £2/mile from Central Milton Keynes. 
Any equipment tried before purchased (even if purchased at a later date) or purchased face-to-face is excluded from this returns policy, and Weyron Ltd reserve the right to not accept a return for any reason.

Used, floor models and ex-demo equipment are excluded from this return policy, and Weyron Ltd reserves the right not to accept the return for any reason.

Refunds

Refunds can only be made in the same way have been paid. As an example, if you have paid cash, we can only refund cash, if paid by card, we can only refund the same card used to pay with, if paid part gold, part cash, the refund will be made the same way only.

Cancellation
You have the right to cancel your order at any point before your delivery was booked without incurring any delivery charges (card processing fee will still be payable because the banks won't return the charges back to us in case of a refund).
Customers who cancel after the booked delivery or those who refuse delivery of dispatched orders will be charged for all shipping costs.
Cancellations must be given in writing via email, fax or letter.
Assembly
Please note that a minor assembly of our massage chairs is required. Read the instruction manual in full before use. 
Warranty
Parts: If any defect occurs within the initial three (3) year time period after purchase, on one or more of the covered parts (see the limitations section below), Weyron Ltd will supply replacement parts to the customer at no additional cost.
In-Home Service: During the initial one (1) Year period following delivery of your Weyron massage chair to the initial owner, Weyron will provide on-site servicing to the initial owner at no additional cost.
This does not apply to certified pre-owned, used, refurbished or floor models. 
If you have purchased your chair from a previous owner, this does not apply. 

The warranty will be provided to the initial delivery address and will be carried on to the new address but we must be notified in writing of the change. The initial owner will be identified with an ID that bares the new address in order to honour the repair on warranty. A refundable deposit may be required.

(Unfortunately, we are unable to provide a warranty or to repair to any other  massage chair brand .)
Extended In-Home Service Warranty (optional): 
For £195, an additional one (1) year parts warranty can be purchased by the original owner at the time you purchase your Weyron Ltd massage chair.
An additional two (2) year option is available for a cost to be quoted by Weyron LTD.
Weyron Ltd is only able to honour extended warranty coverage purchased and confirmed via valid receipt at the initial time of purchase, and cannot be held liable to any claims of extended warranty purchased at a later date.
This does not apply to certified pre-owned, used, refurbished or floor models.
Frame
The massage chair frame is covered by our five (5) year warranty.
If you require a service or repair outside the warranty period, please contact our team directly.
Consumer Warranty Subject to Limitations and Exclusions:
The Limited Warranty supplied with all Weyron chairs will be deemed void if Weyron solely judge any defect to be caused or directly influenced by 
accidents
unstable electric supply or electrical supply not protected by a surge protector that should be purchased and used by the end-user
misuse or unintended use of the equipment outside of the standard operation described in the manual
These limitations include any damage to internal components due to natural wear and tear, incidental damage to the chair’s upholstery after delivery, and any unauthorised servicing, alteration or tampering.
This Limited Warranty does not cover upholstery or covering. Products purchased outside England, Scotland (excludes Scottish islands) and Wales are covered under this warranty for PARTS ONLY.
This limited warranty does not cover the customer for any costs incurred by unnecessary service calls, including costs for in-home service for the purpose of educating the customer about the proper use of Weyron massage chairs.
The warranty provided only applies to the Weyron product purchased and does not include any accessories or enhancements purchased by the customer.
Foams and fillings in pads, pillows and memory foam kits naturally soften with use. As such this does not constitute a defect under your warranty. Nor do visual changes in the upholstery coverings such as fading, wear or piling.
Any natural markings, grain or dye variations in leather or synthetic leather do not constitute a defect due to natural differences.
The Weyron Ltd warranties do not cover any loss or damage resulting from: 
Improper installation
Improper or unauthorised repairs or modifications
Improper or incorrect use of power supply or loss of power
A malfunction or damage of an operating part due to customer failure to provide maintenance as recommended by the manufacturer
Theft, abuse, misuse, neglect, vandalism, or environmental conditions (fire, floods, rust, corrosion, sand, dirt, windstorm, hail, earthquake, or exposure to weather conditions), 
Loss of use while the purchased is at a repair facility or awaiting parts or repair. Weyron Ltd should not be held responsible for the loss of business of any kind. 
If you fail to follow the important safety warnings provided in any Weyron user manual, your warranty will be deemed void.
Under no circumstance shall Weyron Ltd or its representatives be liable for indirect, consequential, or incidental damages (including damages for lost profits, business interruption, bodily injury, medical, and the like), even if any party has been advised of the possibility of such damages.
Warranties are non-transferable and shall be in lieu of any other warranty, express or implied, including but not limited to any implied warranty or merchant ability or fitness for a particular use. 
Weyron Ltd’s sole liability and the purchaser’s exclusive remedy shall be for the repair, or (at Weyron’s sole discretion) for the replacement of any defective part. 
Weyron Ltd reserves the right to make substitutions in lieu of repair or replacement of purchased products.
Warranties do not apply to the demonstration, rental, business, commercial, institutional, or other non-residential users.
This warranty only covers failures due to defects in mechanical parts or workmanship and does not cover normal wear and tear

Finance.

Finance is available in UK only on products above £2500 and is part of these terms and conditions. Finance is subject to approval from Divido which is the finance provider. A credit check will be carried out on all applications. Applicants must be 18 or over, have a good credit history and ability to provide the address history for last three years. Unfortunately, we can only deliver the products at the  applicant's address.
